DEFINITIONS

Personal Data Protection Law (“KVKK”): The Law No. 6698 on the Protection of Personal Data, which entered into force upon publication in the Official Gazette on April 7, 2016.

Güven Asfalt Petrol Ürünleri Uluslararası Ticaret Anonim Şirketi (Güven Asfalt): The legal entity residing at Mutlukent Mah. Gökırmak Sok. No:24 Çankaya / ANKARA.

Data Processor: A natural or legal person who processes Personal Data on behalf of the data controller based on the authorization given by the data controller.

Data Controller: A natural or legal person who determines the purposes and means of processing Personal Data and is responsible for establishing and managing the data recording system.

Güven Asfalt Petrol Ürünleri Uluslararası Ticaret Anonim Şirketi (hereinafter referred to as “Güven Asfalt”) acts as the Data Controller for the personal data specified in this disclosure notice pursuant to Article 3(1)(ı) of the Personal Data Protection Law No. 6698.

Your personal data is processed in accordance with the Personal Data Protection Law No. 6698 and secondary legislation, based on the purposes and legal grounds specified below. When you fill out the Contact Form available at [https://guvenasfalt.com.tr/iletisim/], your Name–Surname, E-mail Address, Phone Number, and your message are processed by Güven Asfalt for the purposes of contacting you, evaluating and responding to your requests, complaints, and suggestions, in accordance with Articles 4, 5, and 6 of the Law and based on the following principles:

Lawfulness and fairness
Accuracy and being up to date when necessary
Processing for specific, explicit, and legitimate purposes
Being relevant, limited, and proportionate to the purposes for which they are processed
Being retained for the period stipulated in applicable legislation or required for the purpose of processing

● Legal Obligations

Based on the legal grounds of explicitly stipulated in the law (KVK Law Art. 5/2(a)) and mandatory for the data controller to fulfil its legal obligations (KVK Law Art. 5/2(ç)):

Güven Asfalt collects and processes your personal data primarily through the contact forms on our website, within the scope of the purposes and legal grounds specified in this disclosure notice and in compliance with the KVKK.

This disclosure notice applies to the personal data collected online and processed within related processes.

STORAGE OF YOUR PERSONAL DATA

Your personal data will be stored based on at least one of the data processing conditions specified in Article 5 of the KVKK and in accordance with the general principles in Article 4.
Personal data is retained for the period required by applicable legislation or necessary for the purposes for which they are processed and is destroyed within the destruction period.

TRANSFER OF PERSONAL DATA

Your personal data may be transferred in accordance with the conditions set out in Articles 8 and 9 of the KVKK:

To courts and public authorities to fulfil legal obligations (KVK Law Art. 5/2(ç))
To legal advisors and consultants for legal representation, dispute resolution, or compliance audits (KVK Law Art. 5/2(e))
To domestic or international suppliers for data storage, backup, electronic systems, website infrastructure, and security services (KVK Law Art. 5/2(f))
To domestic or international suppliers under standard contractual clauses published by the Personal Data Protection Authority (KVK Law Art. 9/4) for secure data storage, cloud services, or backup systems

RIGHTS OF THE DATA SUBJECT

Under Article 11 of the KVKK, every data subject has the right to:

Learn whether personal data is being processed
Request information regarding processed data
Learn the purpose of processing and whether data is used in line with that purpose
Learn about third parties to whom data is transferred domestically or abroad
Request correction of incomplete or inaccurate personal data
Request deletion or destruction of personal data under Article 7
Request notification of corrections or deletions to third parties
Object to results arising to one’s detriment from exclusively automated processing
Request compensation if personal data is unlawfully processed and damages occur

APPLICATION TO THE DATA CONTROLLER

To exercise your rights as the data subject, you must submit your request clearly and understandably—along with documents verifying your identity and address—in writing and with a wet signature, delivered:

to the address below, in accordance with Article 13 of the KVKK and the provisions of the Communiqué on the Procedures and Principles of Application to the Data Controller.

Your request will be finalized by Güven Asfalt free of charge as soon as possible and within 30 days at the latest, depending on the nature of the request.
However, if fulfilling the request incurs additional costs, fees may be charged based on the tariff set by the Personal Data Protection Authority.
